General terms and conditions of sale
Article 1 — Purpose and scope
These terms govern the sale by KONGO HABITAT SARL U of serviced plots and turnkey villas located at Résidence MALKIA, Village of Kongo, Muanda, Kongo-Central, Democratic Republic of the Congo. Any reservation or acquisition implies unreserved acceptance of these terms.
Article 2 — Description of assets
The assets offered are: (a) serviced residential plots of 400, 500 or 600 sqm within the fenced and guarded Résidence MALKIA subdivision; (b) turnkey villas of 3 to 5 rooms built on these plots. Precise characteristics are set out in each property listing.
Article 3 — Prices
Prices are expressed in US Dollars (USD). An equivalent in Congolese Francs (CDF) may be indicated for reference, based on the exchange rate in force at the reservation date. Displayed prices may change; only those in the signed reservation form are binding.
Article 4 — Payment methods
Accepted methods: M-Pesa, Airtel Money, Orange Money, bank transfer, and cash against numbered receipt. A payment schedule, customizable per property, is attached to the reservation form. Online card payments via our Stripe provider are secured in a PCI-DSS environment.
Article 5 — Reservation process
A plot is reserved by paying a deposit whose amount is stated in the property listing. The option is valid for seventy-two (72) hours. Failing signature of the reservation form and payment of the deposit within that window, the plot returns to sale automatically. Refund conditions for the deposit are detailed in the reservation form.
Article 6 — Property transfer
Transfer of ownership occurs upon signing of the notarial deed, after full payment of the price. Kongo Habitat SARL U supports the buyer through the notarial process and delivers the land title issued by the competent cadastral authorities.
Article 7 — Right of withdrawal
In accordance with Congolese law applicable to real estate sales, the buyer benefits from the remedies provided by the texts in force. Precise withdrawal conditions are stated in the signed reservation form.
Article 8 — Warranties and limitation of liability
Kongo Habitat SARL U commits to deliver the assets as described in the reservation form. The company shall not be liable for force majeure or third-party actions delaying the programme.
Article 9 — Programme amenities
The announced amenities (supermarket, bakery, café-brasserie, medical office and pharmacy, green spaces) are planned as part of the development programme and remain subject to completion. Their commissioning depends on the sales calendar and factors beyond the developer's control; failure to deliver them does not create a right to compensation beyond what the law provides.
Article 10 — Seller
The seller is KONGO HABITAT SARL U, a single-member limited liability company of Congolese law, represented by the signature of its Managing Director, Ms. Diane LETA.
Article 11 — Dispute resolution
These terms are governed by the law of the Democratic Republic of the Congo. Any dispute falls under Congolese courts. The parties may also resort to arbitration or mediation, under ordinary conditions.
